Bankruptcy
What options do you have if you cannot pay your personal or business debts? There are legal remedies available to people who cannot pay their creditors. Under the Bankruptcy Code, individual debtors can file for Chapter 7 or Chapter 13 bankruptcy depending on their circumstances and needs. Busineses and business owners can file Chapter 11 bankruptcy. If you cannot pay your debts and think bankruptcy may be the answer, contact the law office of Gregory Van M. Doren, Esq., located in Manasas, Virginia. I help people throughout Prince William County, Fairfax County, and Fauquier County file for bankruptcy and get a fresh start. If you are dealing with creditor or collection call harassment, foreclosure on your home, repossession of your car, and/or wage garnishment, bankruptcy can provide immediate protection. I am always available for my clients, and I will carefully listen to your concerns in order to clearly explain the legal options available to you. Depending on your unique circumstances, types of debt, and other factors, I can help you with the following types of bankruptcy relief: - Chapter 7 Bankruptcy: This form of bankruptcy allows individuals to discharge a large part of their personal debt and does not include a repayment plan like Chapter 13. Instead, Chapter 7 involves the liquidation (sale) of property and assets in order to pay off unsecured debt such as credit card debt. Under bankruptcy law, debtors are often allowed to keep their cars, but you may have to sell other important assets.
- Chapter 13 Bankruptcy: This type of personal bankruptcy is often called the Wage Earner's Plan and helps people needing more time restructure their unsecured debts (credit cards) to allow them to protect their house. Individual debtors with a steady income will develop a repayment plan to pay all or part of their debt in installments over three to five years.
- Chapter 11 Bankruptcy: Often called reorganization bankruptcy, Chapter 11 allows a company - a corporation, sole proprietorship, partnership, or other entity - to stay in business while it reorganizes and plans to repay its debts over time.
Bankruptcy may help you get rid of credit card debt, medical bills, personal loans, and business debts; however, it will not give relief from child support payments, criminal restitution, or student loans. Regardless of your goals in gaining relief from overwhelming debt, my knowledge and experience as a lawyer can help ensure that you get every benefit available under bankruptcy law.
